Leading College Publishers Settle Trademark and Copyright Suit
McGraw-Hill Education, Pearson Education, Inc., and Cengage Learning, Inc. announced they have settled a trademark and copyright infringement lawsuit against individuals doing business as “ACCT-2004” and “CPA-2005.” The lawsuit alleged that defendants repeatedly participated in the selling and distribution of illegal copies of the publishers’ instructor’s solutions manuals. Instructor’s solutions manuals are provided only to instructors because they contain the solutions to problems that students are tested on, and, therefore, the integrity of the assessments are compromised when the answers are circulated. The defendants’ attempted widespread distribution of these materials threatened to impair the academic integrity of the publishers’ textbooks.
The publishers’ complaint, filed in U.S. District Court for the Southern District of New York, alleged numerous violations of U.S. copyright and trademark laws, and sought to stop the unauthorized distribution of instructor solution manuals. To satisfy plaintiffs’ claims, defendants agreed to make substantial payments to plaintiffs under a confidential settlement agreement and to the filing of a consent judgment in which defendants are permanently prohibited from infringing the registered copyrights and trademarks of McGraw-Hill Education, Pearson Education and Cengage Learning, including the selling and distribution of instructor solutions manuals.
“This settlement underscores the firm commitment by these publishers to protect their own intellectual property rights and the rights of their authors,” said William Dunnegan, an attorney representing the three publishers in this suit. “These publishers will continue to pursue legal action against those businesses and individuals who violate their intellectual property rights.”
